Jadhav has 150 days: Pak

The ICJ is hearing the case of Jadhav, the former Indian naval officer, who has been sentenced to death by Pakistan on charges of being a spy.

The legal team for India, led by former solicitor general Harish Salve, is likely to focus on Pakistan's violation of the Vienna convention when it came to granting India consular access to Jadhav, and also the army court's lack of transparency which qualifies for the trial to be declared illegal.

Today the International Court of Justice initiated its hearing towards Indian national Kulbhushan Jadhav's death verdict by Pakistan.

He said India made endless solicitations for consular get to, however, Pakistan declined to give reports identifying with the case and consular access to him.

But India has denied he was a spy, and last week lodged a protest at the ICJ in The Hague accusing Pakistan of "egregious violations of the Vienna convention". However, the ICJ denied permission to the Pakistani side to play the video at the hearing, Indian officials in New Delhi said.

"We should be successful in stopping the execution, letting Jadhav off the hook and allowing consular access to him by our Indian authorities, so that he can be given a fair trial". Several bilateral talks, including maritime security dialogue, were cancelled or postponed by India in response to Jadhav's death sentence.

It also said that India could avail a "short extension" beyond 90 minutes to present its case, the judge had said in his opening remarks.

This morning, Attorney General Mukul Rohatgi, expressed optimism saying that India has the upper hand in the matter. India has sought immediate suspension of Jadhav's death sentence. Additionally, India alleged that "it was not informed of Jadhav's detention until long after his arrest".

These were on March 30, 2016, May 6, 2016, June 10, 2016, July 11, 2016, July 26, 2016, August 22, 2016, November 3, 2016, December 19, 2016, February 3, 2017, March 3, 2017, March 31, 2017, April 10, 2017, April 14, 2017 and April 19, 2017. "Pakistan has not provided the chargesheet, any documents on the case despite repeated requests", Mittal told the court.

India is seeking relief in the form of immediate suspension of the death sentence. Earlier in 1971, India had moved the Hague-based world court when it questioned the International Civil Aviation Organisation's powers to decide Pakistan's complaint about New Delhi denying its airlines from flying over India.

Pakistan said Jadhav had a 150-day period to seek clemency and could challenge his sentence in the high court.

India has further claimed that Jadhav was kidnapped from Iran where he was involved in a business undertaking. No connection with government.
