Cleveland Police Officer Who Fatally Shot Tamir Rice Fired

Officer Frank Garmback, who drove the patrol auto to the park, "would be suspended for 10 days beginning Wednesday", The New York Times reports.

The shooting sparked outrage and became one of many acts of police terror that galvanized a movement for Black lives in the USA against police brutality and murder.

The city of Cleveland settled a wrongful death lawsuit previous year with the Rice family for $6 million. An evaluation in the suburban department's file had said Loehmann had a "dismal" handgun performance, broke down in tears at the gun range and was emotionally immature.

Garmback suspended for using "improper tactics" when driving up to the gazebo near which Rice was shot. Surveillance video contradicted his account, showing Loehmann shooting Rice just seconds after the patrol vehicle pulled up to the boy. "There is simply no factual basis on which an unbiased decision-maker could conclude that either Officer should be administratively disciplined", CPPA President Steve Loomis in a statement.

Loehmann shot Rice after he and his partner responded to a 911 call about a person in a park waving a gun. He told the dispatcher that the guy could be a juvenile and the gun might be a "fake", information that wasn't conveyed to the officers.

On May 30, Cleveland police announced that Loehmann was terminated from the police department, effective immediately, not for firing the fatal shot, but for lying on his police application. A grand jury declined to indict Loehmann and Garmback in December 2015. The incident was caught on surveillance video, which also showed the officers tackle and handcuff Rice's 14-year-old sister, Tajai Rice, as she ran toward her dying brother. Williams said both officers were notified of their fates Tuesday. "We have to go through our process, we have to be fair and objective to everyone in this process". "I think our officers have learned that there are best approaches to incidents and with the training that they are receiving, to bolster the training they've had in the past, hopefully we won't have any more incidents like this". "Timothy Loehmann should have never been a police officer in the first place".

Tamir's mother, Samaria Rice, expressed mixed feelings about the discipline.

She also added that Officer Garmback should have been fired, not suspended "for pulling up so close to my son to create the danger" at the time of the shooting incident.

The officer, William Cunningham, had been working at the rec center on Saturdays for years and assisted Garmback in wrestling Rice's sister to the ground at the scene.

"We still need accountability", Rice said.

Loehmann's violation relates to what he had entered on his application's personal history statement, Williams said without elaborating.
