Jurors Hear Cosby's Story -- But Not From Him

Friday's prosecution witness was Dr. Veronique Valliere, an expert on the behavior of sexual assault victims. Although almost 60 women have levied allegations of sexual assault against him - all of which Cosby and his legal team have vehemently denied - it was the first time he faced a criminal charge.

She said feelings of self-blame and confusion are exacerbated if intoxicants are involved. Most times it's not violent. But I just don't want to sit there and have to figure out what I believe is a truthful answer to whether or not I'm opening a can of something that my lawyers are scrambling.

"People who go through these events can be depressed, anxious", she said.

"She is now telling this jury that this defendant is guilty", McMonagle protested. The sequestered men and women were selected from a pool of Allegheny County residents and bused to Montgomery County last week. That request would ultimately be denied. Presiding Judge Steven T. O'Neill predicted that jurors will start deliberating early next week. Valliere countered that point, explaining that victims frequently do not react immediately as they process what happened to them - particularly when the assaulter is famous.

"This is your argument and I understand your argument".

According to the deposition, Ms Constand's mother repeatedly asked Cosby over the phone about the pills he had given her daughter, but Cosby refused to tell her what they were and said he would send them in the mail, which he never did.

Cosby said in the deposition that he gave her Benadryl from his own reserve because Constand had complained about stress and neck pain, and he wanted to help her relax.

The comedian gave the deposition as part of a lawsuit filed by Constand and later settled for an undisclosed sum.

In the excerpts, Cosby spoke about apologizing to Andrea Constand and her mother during a telephone conversation about a year after Constand says he drugged and violated her. The defense has questioned Constand's continued contact with Cosby after the alleged assault and conflicting reports of when the incident occurred.

If convicted, Cosby could spend the rest of his life in prison.

The major prosecution witnesses have already testified, including Constand and another accuser, Kelly Johnson, who described a similar assault in Los Angeles in 1996. She also told police that she had a boyfriend in her teens and sexual contact with a male in her late 20s.

The newspaper does not normally identify victims of sex crimes without their consent but is using Constand's name because she has identified herself publicly. Sometimes, this is a factor in the shame felt by victims.

Constand's sexual orientation has not been mentioned during the trial.

If Cosby testifies and prosecutors are then allowed to ask about those other women, said Oliver, the Duquesne University law professor, it would drastically tilt what, in the eyes of the jury, amounts to a "he said, she said" case.

About 50 women have made allegations against Cosby. Rohrig, who serves on a national committee involved with drug-facilitated crime research, said the drug has been used to facilitate sexual assault. Prosecutors have suggested he gave her something stronger - perhaps quaaludes, a highly popular party drug in the 1970s that was banned in the United States in 1982.

In the deposition, Cosby said he gave Constand three half-tablets of the cold and allergy medicine Benadryl. Prosecutors implied that Cosby was trying to buy her silence. O'Neill had cleared the way for prosecutors to present it.
