Leticia Gonzalez, an attorney for the Hernandez family, said Thursday that Rosa Maria was taken with a cousin from the Texas border city of Laredo to a children's hospital in Corpus Christi, about 150 miles away. En route to the hospital, they were stopped at a Customs and Border Patrol checkpoint.

A few weeks ago, severe stomach pain sent Rosa Maria to the hospital, where doctors discovered kidney stones.

For her part, De La Cruz is glad is doing well-Hernandez told Newsweek that Rosa Maria was released in stable condition-but worries about what awaits her at Bexar.

On Tuesday, Rosa Maria Hernandez and her adult cousin, a United States citizen, had to go through an interior Border Patrol checkpoint while in an ambulance to get from Laredo, Texas to a Corpus Christi hospital for emergency gallbladder surgery, said family attorney Leticia Gonzalez on Thursday. Gonzalez said Rosa Maria has "difficulty understanding exactly what's taking place" and is closer in development to a child that's 4 or 5 years old.

De La Cruz was able to video chat with her daughter in the children's home, but she still doesn't know whether Rosa Maria will ever return home to Laredo.

It is not in dispute that Rosamaria is an undocumented immigrant, as are her parents; seeking better medical care, they traveled over the southern border together when she was three months old, and settled in Laredo, Tex.

It said Border Patrol agents were "committed to enforcing the immigration laws of this nation".

Rosa Maria's story highlights the newfound relentlessness in immigration arrests and detentions.

Galvez said Hernandez should be back in her mothers arm in about 21 days. A community center helped arrange for Rosa Maria to receive treatment through a government program for children with certain chronic, debilitating conditions that require specialized care. Doctors in Laredo informed her mother, Felipa De La Cruz, who is also undocumented, that the nearest children's hospital capable of doing the operation was in Corpus Christi, a port city two and half hours away by auto. "Rosa Maria should never have been placed into removal proceedings, we now ask that you administratively close her proceedings".

While she was recovering in the hospital, up to four federal agents were stationed outside her open hospital room door, Gonzalez said. And then snatched her upon release.

In September, a man and woman, who were in the U.S. illegally, were followed by Border Patrol to the same hospital when their newborn child needed surgery.

Rosa Maria is now in a shelter run by the Office of Refugee Resettlement, which falls under the Department of Health and Human Services, as is customary with undocumented, unaccompanied minors. She says the border patrol agents had the discretion to let the child go. "They just refused to allow the child to go home", Gonzalez said Thursday. The hospital was embroiled in controversy in September when NPR reported that the undocumented parents of a two-month-old infant receiving treatment were detained by immigration officials upon arrival in May.

"I've always been at her side, and now that she needs me I'm not", she told Telemundo on Wednesday.

There, they waited for her to get our of surgery.

An Immigration and Customs Enforcement official said the agency had no involvement in the specific case.

That notice to appear usually comes from Customs and Border Protection once they encounter and process the individual.
