SCA rules against Zuma and NPA in spy tapes appeal — Newsflash

South Africa's Supreme Court of Appeal ruled on Friday that President Jacob Zuma can face prosecution over nearly 800 charges of corruption relating to a 1990s arms deal.

Judgement in the eight-year-long court battle will be handed down in Bloemfontein on Friday.

The High Court in April 2016 ruled that the 2009 decision to withdraw the 783 charges was irrational and should be set aside, which had the automatic effect of the charges being reinstated against the president.

Machirunga said that in the event that the judge rejects the appeal, but the NPA chooses not to continue with prosecution, then in his opinion the only remaining remedy would be a private prosecution.

The National Prosecuting Authority and Mr JG Zuma are to pay such costs jointly and severally, the one paying the other to be absolved.

Either of the two may yet approach the Constitutional Court or they may decide to drop the the appeal route.

Since then, the DA has challenged the matter in court.

On 14 September, the SCA reserved judgment after Zuma's lawyers admitted that the quashing of hundreds of criminal charges against him was "irrational".

The tapes, given to the National Prosecuting Authority (NPA) as part of Zuma's "representations" as to why he should not be prosecuted, were recordings of telephone conversations, mostly between former Scorpions head Leonard McCarthy and the first national director of public prosecutions, Bulelani Ngcuka.
