Sources familiar with the matter told Bloomberg that if the Justice Department sues to block the merger, AT&T will ask the court to review communications between DOJ and the White House as part of the discovery process. In addition to the Department of Justice, the Federal Communications Commission is reviewing the deal.

The Justice Department's antitrust division is poised to file a lawsuit to stop the deal if it can't reach an agreement with the companies.

Per a senior administration official: "This Justice Department under this Attorney General is not going to play the James Comey game and confirm, or even deny, the existence of criminal investigations - but this letter makes it clear that Sessions is taking the Uranium One issue very seriously". Then, he concluded: "I didn't make a statement, but I did make a statement long before. But I do believe you should have as many news outlets as you can".

Given the rocky relationship between President Donald Trump and CNN, which is owned by Time Warner, suspicions has arisen about Trump potentially intervening with the DOJ review.

AT&T will also try to get any evidence about whether Rupert Murdoch tried to influence the review, according to one of the people.

Context: President Trump, some congressional Republicans and Fox News personalities have been braying for Sessions to investigate the Clinton Foundation and the Uranium One sale.

Paul Gallant, an analyst with Cowen Research, said that AT&T is likely to win a court challenge and that public questioning of Trump's motives could help the case. Now-President Trump originally objected to the merger over his clashes with CNN, a unit of Time Warner-owned Turner Broadcasting System which he repeatedly called "fake news" and accused it of giving him unfair coverage, both as a presidential candidate and later President. Fox didn't immediately respond to a request for comment.
