Senate Orders Ndume To Resume Wednesday Following Court Order

Announcing resumption, the Deputy Senate President, Senator Ike Ekweremadu, said Ndume should resume plenary session on Wednesday.

Ekweremadu said the lawmakers agreed that the senator be allowed to resume "without prejudice to the case pending in court".

The News Agency of Nigeria recalls that the Senate had, on March 29, suspended former Senate Leader Mohammed Ndume over his call for an investigation into the allegation that Sen.

The Borno senator‎ had asked the senate to investigate the allegation that the red chamber was exacting vengeance on Hameed Ali, comptroller-general of the Nigeria Customs Service, because of a seized bullet-proof vehicle allegedly owned by Saraki.

Not satisfied with the decision of the lower court, the Senate yesterday approached the Court of Appeal to unturn the judgment of the court.

The court also ordered that Mr. Ndume be paid all his outstanding salaries and allowances.

Sam Anyanwu, submitted his committee's report which recommended that "the Senate do suspend Ndume for bringing Sen".

The appellant is further praying the appellate court to dismiss Ndume's suit.

The Senate had on Monday filed an appeal against the judgment of the Federal High Court, delivered today, 10th of November, 2017 which declared the suspension of Ndume null, void and of no outcome.

"That the Plaintiff wrongly joined several causes of action in his Originating Summons".

Besides, "that by the provisions of sections 3 and 30 of the Legislative Houses (Powers and Privileges) Act, the trial court lacked requisite jurisdiction to hear the suit of the Plaintiff".

The motion asked for an order for stay of execution on the judgment of the court and to maintain status quo that existed before the judgment of the trial court pending the hearing and final determination of his appeal at the court of appeal, Abuja and for such other orders, the court may deem fit.

Mike Ozekhome, counsel to the senate, on Sunday said the upper legislative chamber "respectfully" disagrees with the judgment.
