Supreme Court rejects challenges to assault weapons ban, open-carry policy

"CONTINUE FIGHTING" The NRA's Institute for Legislative Action took issue with the court's refusal to hear the appeal, saying in a statement that a 2008 ruling by the justices "clearly stated that arms in common use for lawful purposes are protected by the Second Amendment and thus can not be subject to an outright ban".

According to the Washington Times, SCOTUS passed on the opportunity to hear either appeal, leaving the bans on open carry and "assault weapons" intact.

The 4th Circuit, in upholding Maryland's law, noted the disproportionate use of semi-automatic assault rifles in mass shootings and said these weapons are like the military's M-16 machine guns, which the Supreme Court in its 2008 ruling agreed may be banned.

The U.S. Supreme Court, which has avoided major gun cases for seven years, on Monday declined to hear a challenge backed by the National Rifle Association to Maryland's 2013 state ban on assault weapons enacted after a CT school massacre.

But the court opted not to take up the case, in a decision issued without comment.

Maryland passed the sweeping gun-control measure after the 2012 Sandy Hook Elementary School massacre that killed 20 children and six educators in CT.

Maryland's Firearm Safety Act of 2013 bans the AR-15 and other military-style rifles and shotguns, often referred to as "assault weapons", and detachable large-capacity magazines.

In the Florida challenge, the state Supreme Court upheld Florida's ban on open carry finding the Second Amendment doesn't guarantee a right to open carry.

"Especially when you look at the carnage at Newtown and elsewhere around the country".

Defendant Dale Lee Norman, who had a permit to carry a concealed weapon, was convicted of openly carrying a handgun in 2012 near his home in Fort Pierce, Florida.

Some gun enthusiasts wanted Florida to join the many states with so-called "open carry" laws, saying it can be a deterrent to crime.

"This Court recognized and protected the principle at the heart of the interests enshrined by the Second Amendment: The individual - and not the government - retains the right to choose from among common arms those that they believe will best protect their person, family, and home", they wrote in briefs. In 2010, it ruled the amendment also applied to state and local laws. There was also little evidence that such guns are well-suited for self-defense, the 4th Circuit added.
