CFPB's Leandra English Just Asked for a Preliminary Injunction Against Mulvaney

Mr. Mulvaney said he had removed the hold on Wednesday - the day the agency was scheduled to make one of its twice-annual allocation decisions - and approved the dispersal of payments.

After just a week on the job, the credit union says the CFPB's new director is "already gutting [it], undermining its mission, and reportedly rolling back regulatory protections that protect the credit union's members".

"Then I'm going to get down to the weeds of something I enjoy which is the budget, and how the agency.is funded, how it's structured, personnel, those types of things", he added.

That review would include the agency's structure, funding, and staffing, he said. Republican lawmakers dislike that structure and have repeatedly introduced legislation (S. 387) to allow Congress to control the CFPB's purse strings.

Mulvaney said he has modified the initial 30-day hard freeze on new CFPB enforcement actions he announced November 27 during his first day at the bureau.

The Dodd-Frank Act stipulates that the agency's deputy director shall serve in the "absence or unavailability" of the director, but the White House argued that the law is superseded by the 1998 Vacancies Reform Act, which gives the president the power to name interim heads of executive agencies.

Some actions will move forward while others remain on hold as Mulvaney's team gets more details on each case, depending on what stage they are in.

Mr. Mulvaney said he had not spoken directly with Ms. "I don't like the fact that CFPB exists, I'll be perfectly honest with you", Mulvaney had said.

The budget chief said data security was also a top priority and that he had instructed the bureau to stop collecting personally identifiable information until data security problems highlighted by the bureau's independent audit office had been addressed.

General statistical data collection on loans, such as volume and dollar amount may continue, but staff will not collect more detailed information "until we have the data security issue buttoned down" to the satisfaction of the CFPB's inspector general.
