'Arrogant' surgeon burned his initials onto patients' livers during transplants

"Arrogant" surgeon avoids jail after branding transplant patients with initials during surgery A surgeon who burnt his initials into a patient's newly transplanted liver has avoided jail despite the freaky "abuse of power" at a United Kingdom hospital.

"The Associated Press reports that a prosecutor called the case 'without legal precedent in criminal law'".

"Arrogant" Simon Bramhall, 53, used an argon beam machine to write on the organs of two anaesthetised victims at Birmingham's Queen Elizabeth Hospital. He resigned from his job at Birmingham's Queen Elizabeth Hospital in 2014.

Passing sentence at Birmingham Crown Court in central England, judge Paul Farrer said Bramhall displayed "professional arrogance of such magnitude that it strayed into criminal behavior".

He said the victim who had been identified in the "unique" case had suffered minor physical injury and psychological harm.

"What you did was an abuse of power and a betrayal of trust that these patients had invested in you".

In a victim impact statement, the woman said she had at first thought the report was "too farcical" to have happened, before realising she had been one of Bramhall's patients.

"I accept that on both occasions you were exhausted and stressed and I accept that this may have affected your judgement".

The court heard Simon Bramhall was "extremely sorry" and wanted to apologise to the patient.

Bramhall's initials, which measured 1.5 inches (4 cm), were subsequently spotted by another surgeon.

Patient A said she was shocked to discover Bramhall had branded his initials on her during a life-saving operation. I think it should have been thrown out.

She said her trust in doctors had been destroyed, adding: "My lack of trust in the doctors made me question what could have gone wrong with my new liver". I genuinely believe that the failure of the liver was due to the actions of Simon Bramhall burning his initials on to it.

A photograph of the 4cm-high branding was taken on a mobile phone and Bramhall, who now works for the NHS in Herefordshire, later admitted using the argon beam coagulator to mark Patient A's liver.

A nurse who witnessed the surgeon's actions said she had asked him what he was doing; he is said to have replied: "I do this". Speaking to the press at the time, he said marking his initials on to his patients' livers had been a mistake.

He told police it had been a misguided attempt to relieve the tension in the operating theatre.
