Chandigarh stalking: HC grants bail to Haryana BJP chief's son

Vikas Barala has been granted bail by the Punjab and Haryana High Court, five months after he allegedly stalked and attempted abduction of Chandigarh-based DJ Varnika Kundu.

According to a report inHindustan Times, call records proffered by Barala's lawyer showed Kundu wasn't in the city right before the incident on the intervening night of 4 August and 5 August past year.

"No application was filed on behalf of the prosecution alleging that the accused had made any attempt to influence anybody", said Vinod Ghai, the counsel for Vikas.

His counsel had sought a regular bail last month from the high court, submitting his client had been behind bars for four months.

Since his arrest last August, Vikas has been lodged in Chandigarh's Burail jail with his friend and co-accused Ashish.

They are facing trial on charges of stalking and attempt to kidnap Kundu, daughter of Haryana IAS officer VS Kundu, on the night of August 4.

The high court bench of justice Lisa Gill, while allowing his bail plea, asked Barala to refrain from trying to establish contact with Kundu, her family or other witnesses in the case and not to try and influence them.

The latest development comes a day after Varnika's cross-examination had concluded in the district courts in Chandigarh. "And if the court thinks it's OK to release him on bail, then I don't challenge that decision". She also said that Barala and Kumar even approached her auto and attempted to get in.

Earlier, the court had ordered the Chandigarh Police to provide information on call details of Barala, son and his friend Ashish Kumar. Both were booked under section 354 D (stalking) of the IPC and under the provisions of Motor Vehicle Act.
