SC stays proceedings against Army officer accused of Shopian firing

The manner in which the lodging of the FIR was portrayed and projected by the political leadership and the administration reflected the hostile atmosphere in the state, he said.

Apart from staying the petition, the Court also sought replies from the state as well as from the Central government within two weeks.

Commenting on the ruling passed by the apex court, Major Aditya's counsel said that the Court stated that no coercive action will be taken against Major Aditya Kumar by the Jammu and Kashmir Police.

The stay order comes after the accused Major's father Lieutenant Colonel Karamveer Singh filed a petition claiming that the authorities were aware that the Major "was not there", but "in an arbitrary exercise of power, named my son as an accused". "It is a positive encouraging day". Kumar's name had appeared in an FIR filed by J&K Police after three people lost their lives during protests last month.

It also sought directions to issue guidelines to protect the rights of soldiers and adequate compensation.

Criticising the Supreme Court order favouring an Army Major accused of killing civilians in Shopian district on January 27 at the cost of the victims, the Jammu and Kashmir Coalition of Civil Society (JKCCS) said the order only strengthens the belief that there can be no expectation of justice from the Indian state and its institutions. The army had said the soldiers fired in self-defence after an administrative convoy was attacked by stone pelters in the village.

Two youths were killed on the spot, while the third one succumbed to his injuries later at the hospital.

Aside from the FIR, the state government headed by chief minister Mehbooba Mufti also instituted a magisterial inquiry+ to look into the matter and submit its report within 20 days.

The unruly behaviour of the unlawful assembly reached its peak when they got hold of a Junior Commissioned Officer and was in the process of lynching him.

The court issued notice to the Centre and asked Attorney General K.K. Venugopal to represent the government and assist the court.
