Judge refused to rule on the question of Canada recognizing same-sex marriages and unions from other countries. Rejected spouse returns to UK
In our April lead story, Is Marriage, By Any Other Name, Still Marriage?, I told you about Will, the Gay married British man who was the victim of spousal abuse, and was then thrown out of his home without any property or personal possessions. Unfortunately, he has lost his legal battle in the Canadian court system. Will had been seeking a divorce, and a partition of the matrimonial home and its possessions. The judge in the case, The Honourable A. Duncan Grace, would not render any decision due to the fact that it would be too precedent-setting in the eyes of the Canadian Government. The judge did not feel comfortable being in a position where he must force Canada to recognize another country's same-sex marriage laws with an implication for Canada's immigration laws.
